Default Va state trooper and no radar detector? Fair, or Unfair?!?

i was pulled over for speeding, doing 84 in a 55. I asked the state trooper if i could see the radar detector to see if i really was going that fast and he replied with, "No you can not see it, i don't have to show you if i don't want too." and also "I clocked you going 84, and the second time i clocked you going 79," I simply said, why can't i see it? and he replied with, "Because i don't have them, they automatically erase from the system after i clocked you."Now i was told, by my lawyer, and fellow police officers, that it is your right to see the radar detector,and the state trooper or any police personnel have to show it to you regardless. Now because i was denied my right to be shown the evidence, the proof, i should not be receiving this ticket. For all i know, he could of charged me doing 110 in a 55...i don't know how fast i was going, i wont plead guilty because i simply wasn't paying attention to my speedometer at the time, and i couldn't see the radar detector.

First of all it is called a RADAR GUN, we as officers do not have radar detectors in our cars. Second he or she doesn't have to show it to you that is what the court date is for. YOU have to prove that you weren't going that fast. If you were doing 110 in a 55 you would have gone to jail. Take it to court and fight it but I will bet you any amount of money you will not win. All he or she has to say was you were being really off the wall and didn't feel safe turning their back on you and your theory flies out the window of having to show you the gun reading.

Fair or Unfair???This is the LAW.The law is not fair. It's not meant to be.Get past "fair".Good luck.

Your lawyer, and the other Police Officers are incorrect. You do not have to be shown the radar readout. It is your responsibility to know how fast you were driving.

The officer is only required to produce evidence at your trial, and not at the time the citation is being issued. At that time, you may scrutinize his evidence to your heart's content. However, you are NOT required to prove you were not speeding. The burden of proof falls upon the officer on behalf of the state, as to proving your guilt. Every man, woman, and child accused of a crime in these United States of America is considered innocent until proven guilty in a court of law. The person who answered that you will have to prove you were not speeding is, unfortunately, incorrect.Footnote: When running radar, I never lock in the offender's highest speed. I continue the track the offending vehicle for as long as possible to verify to myself, as well as the court, that I am indeed tracking the correct vehicle. Locking in the speed would remove supplementary evidence that could assist me in proving my case. I'm sure the officer who issued your citation may have had similar reasons. You will certainly find out at your trial, if you choose to have one. Good luck.

No, the officer is not required to show you the radar readout. From a safety standpoint, it is unwise to let you out of the car.You can argue in court that you asked to see the device and was refused and on that basis you are challenging the officer assertion that you were speeding. The court will tell you there is no right to endanger the officer or yourself just to view the radar readout. The court will accept the word of the officer that you were speeding. Your contention that you weren't ". . .paying attention to my speedometer. . ." is not a defense. Pay the ticket, save yourself some grief.

As a former Officer myself, I most say that you were wrong for speeding in the first place. As the operator of your vehicle, you should be aware of everything around you , including your SPEEDOMETER :-) I must say I agree with Brenda, just save yourself the grief and pay the ticket.
